1. Agreement to Terms

By accessing or using ExamMark (exammark.ai / exammark.com), you agree to be bound by these Terms of Service and all applicable laws and regulations.

If you are under 18 years of age, you confirm that you have obtained permission from a parent or legal guardian to use the platform.

2. Purpose of ExamMark & AI Marking Disclaimer

ExamMark is an advanced revision and diagnostic learning tool. Our AI marking engine evaluates handwriting against official examination rubrics and mark schemes to provide formative educational feedback.

3. Accounts & Token System

• Account Responsibility: You are responsible for safeguarding your login credentials and for all activities that occur under your account.
• Free Trial Credits: Eligible new users receive introductory credits to mark practice papers at no cost.
• Pay-As-You-Go Credit Packs: Additional credits can be purchased securely through Stripe. Each credit entitles you to mark one past paper script up to our supported page limit (up to 30 pages per exam).
• Refund Policy: If a marking job fails due to a system error or timeout, the deducted credit is automatically refunded to your balance immediately. For billing inquiries or purchase refunds, contact support.

4. Acceptable Use Policy

When using ExamMark, you agree not to:

• Upload live, active, or embargoed examination papers that violate examination board copyright or academic integrity regulations.
• Upload unlawful, abusive, defamatory, or obscene material.
• Attempt to reverse-engineer, decompile, scrape, or overwhelm our API services with unauthorized automated tools.
• Share account credentials or abuse free trial systems through multiple artificial registrations.

5. Intellectual Property Rights

You retain complete ownership of all original handwritten notes, essays, and exam scripts you upload to ExamMark.

All software, user interfaces, branding, logos, algorithms, and documentation associated with ExamMark are the exclusive intellectual property of MyMegam Ltd. Past examination paper names and trademarks (AQA, Pearson Edexcel, OCR) remain the property of their respective trademark holders and are referenced for syllabus compatibility and fair-use educational guidance only.

6. Limitation of Liability

To the fullest extent permitted by applicable law, ExamMark and MyMegam Ltd shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the service, academic examination outcomes, or reliance on AI-generated feedback.

7. Modifications to Service & Terms

We reserve the right to modify these Terms of Service or enhance features at any time. Notice of significant material changes will be posted via our Changelog or communicated via email. Continued use of the platform after updates constitutes acceptance.
